Being as tomorrow is Monday, I think it is time to review the appropriate response to any questions that deal with taking responsibility.

I have flown, listened to and studied Senior Officers and Politicians. I have boiled down the response given, when not wanting to answer a question or, take responsibility. They are:

Let us look at some recent examples of self investigation:

1. The Church - Sex and other abuse covered-up, for years.

2. The Military - Bad numbers for purchases. Lost Records. Covering for others wrong doing.

3. The Police - Always been a problem. Multiple court cases.

4. The Government - Spending and the care free way they use taxpayers money. Lose a billion here and there, no problem. The poor Auditor General

It is 2013. Wake up. The days of honour are sadly behind us. It has been proven over and over again. If an organization investigates itself, there will be cover-ups. It is why we need courts, justice systems and investigators.

Senators can't be trusted. Mike Duffy and crew covered that nicely. Mike, did so well at it, that the government too, is changing stories to fit the current days situation. His buddy that gave him $90,000.00 got the boot but Duffy is not going anywhere. Now there is a good friend. You lend me money. I get caught. You loose your job. I still keep mine with all the perks I can squeeze out of the taxpayers. There is some honourable Senatorial work for you.

While I am on the subject of honour. Where is our Queen's Representative. Our Commander in Chief.

The law and order, the tough on crime party. The Conservatives have lost their shot at credibility. The military and church have got the corner on cover-ups. Theirs are just whoppers, but, got to give them credit. They do try and still try to cover it up. I still do not know why. It is so obviously wrong. We know it. They know it. But they still try.

News flash........most of us are now educated. We do our own banking and everything. We have kids, homes and responsibilities  If we get accused of something, we can't call Bob the neighbour in to clear our name. No sir, we have to go to court.

It is not our first Rodeo. Our rules are okay with us because they work. Your self investigative work does not. The Quebec Public Inquiry is proving that.

I have been holding out on this true story till now. I believe that it demonstrates the two tiered justice system we have come to know and hate with this government. On one hand, Mr. Harper says he is for getting tough on criminals. Let us now do a comparison on them verses us on the Justice Meter:

I, as the Aircraft Commander, was flying multiple, back to back, night Search and Rescue missions in my CC 130 Hercules. We were out three consecutive nights, saving lives. When I returned to base the Messes were closed and the only place open was my favorite pizza joint. I called from the Squadron and ordered my pizza, on these three nights. Since our aircraft carries no meals, after multiple hours of hard flying, you land hungry  Because of this fact, DND would cover a small amount of money so you could eat something before going home. I did and there in lies the problem.

I was exhausted. I ate my little pizzas on these nights and was so tired, I forgot to take the receipt off the box and hand it in for payment. As an honest guy I went to the pizza guy, told him what I had done and he gave the 3 replacement receipts. All very legal and legitimate.

I got a call about a month later from the Military Police. They were launching a full investigation into my receipt claim because they were sure they were fraudulent. True to their word, they sent over a Cop to get my statement. I explained the circumstances to the Cop but he was still sure I was a fraud over 3 pizzas.

Now to put this in context, my aircraft which I was commanding was worth over 30 million dollars. I have blank signed government cheques and credit cards with no limits so that I might purchase fuel, accommodations for the crew or repairs while on the road.

The Cop was so sure of his thoughts on fraud, he demanded we go see the pizza guy and interrogate him. I was not allowed to be present since I might influence the pizza guys story. My story was exactly the same as the pizza guys story and as a summation to the Cops report he stated," We could not disprove his claim!" Isn't that a kick in the chops.

Next time I started the aircraft, I let it sit and warm up a while thinking about how much it costs for the fuel flowing through my 4 jet engines vise the cost of 3 pizzas and the audacity it took for the Senior Officers to think, I might stoop so low as to claim pizzas I did not get.

The Government

Well now that you understand justice for an honest aircraft commander. Let us look at the justice for an Honorable Senator. He claims expenses for living one place that he actually does not. He got money, $90,000.00 for it. He got a cheque, with strings attached (PM's lawyer written), from the PM's Chief of Staff. No police. No documentation. No investigation by outsiders.

So to RE-CAP: 

Mike Duffy's pizzas (SO TO SPEAK) were $90,000.00 claimed / paid by me the taxpayer. Refunded to me by the PM's Chief of Staff who needed a legal agreement for his friends loan / gift.

Me, an Officer, Captain, Aircraft Commander claim 3 pizzas totaling no more than $40.00, am fully investigated. Interrogated.  Driven to the QUOTE; SEEN OF THE CRIME, UNQUOTE by the police. They held the pizza owner for questioning. Final results were: I could answer one of the most challenging of all questions........Where do you live? and they: could not disprove my claim that everything I stated was true.

What was that law they brought in saying citizens could make an arrest and hold someone for the police if: theft was involved. My tax dollars are real money and if taken fraudulently, should be dealt with by the police.

We as Veterans, have in most part, been patient, law abiding, system following protesters.

We as a group, must be the best mannered protesters ever. No one wants to upset the police or the calm on the hill but, there comes a time where actions are louder than words.

There are the old Veterans. There are the new Veterans. I think that this living document called, "The New Veterans Charter" is not making the grade. I think it is time we get together, ALL OF THE VETERANS TOGETHER, and tell them on the hill.

 Nigel quit. Duffy is calling the RCMP from his cottage in PEI to get rid of

 journalists. Wallin still hangin' in there. Our government misplaces billions of 

tax dollars. They under estimate by millions on purchases of Jets and the  

public should feel no anger or bitterness. What happened to morality as these 

people approach the trough? Does the trough hypnotize them into believing 

WE ARE WATCHING!

they are now God like and untouchable? Some may say that it is a wonderful 

compound and great for growing things. I still call it what it is.......SHIT!

 

I remember when, a long time ago,

that if you didn't know where you lived, you

would be going for a pschyc exam not heading to the Senate

 for more money. 

1. I remember, a long time ago, that when you claimed something that you 

were not entitled to receive, and got money for it, that was called fraud!

2. I remember, a long time ago that when you gave someone money to get out

of a fraud, that was called, being an accomplace! 

That was a different time...... before that temporary tax was brought in for the 

first world war. It is now 2013 not 1918. I just paid my temporary annual tax 

bill again!! I hope I gave the Governor General and Senate enough. If I didn't,

please let me know so I can go out and find another occupation to help cover

their costs. The poor things, we wouldn't want them to starve.  Especially Mike

 Duffy. He looks a little thin these days, don't you think?

UNACCEPTABLE!

I have two distinct and separate cases, plus a Constitutional Challenge. The Federal Court cases are one of lost documents and the hardship on Veterans trying to get benefits from VAC. The second is a Constitutional Challenge on our requirement for swearing allegiance to the Queen and not Canada.

My last issue is dealing with my lawyer request to the Federal Court. With a military caused mental disability, I requested a lawyer be supplied because I am diagnosed, disabled. The Federal Courts response to my disability request was, to send me a book of court rules. Unacceptable!

Accountability - Where?

14 years I have been at this with the Government, with most of it being muzzled by the Orders. You would think that if someone sticks at something for so long, something very bad must have happened.

So far, the Government holds to their story that, all the documents, including the legal ones in my case, were either lost or destroyed.

DIGNITY

What happened was more than bad. It was shameful  It was not in accordance with the Orders. Yup! those pesky Orders. The ones that get pulled out and thrown at you if you just a trooper.  We are certainly held accountable. If you are a Senior rank, the same Orders don't seem to apply the same.

HONESTY

Mike Duffy, a Senator, doesn't even know where he lives. The Chief of Staff gives him $90,000.00 and from his account, doesn't even know him well, from what the news says.

INTEGRITY

I'm taking the military to Federal Court for issues with my misplaced documents and the ramifications of that fact. Being diagnosed with a permanent mental disability, the Federal Court, when asked by me for legal help, sent me a book of Court Rules. This is the same as giving someone in a wheelchair, a bag of cement and a book on how to build a ramp. That would still be a bag of cement more than what I got from the Court.

LOYALTY

My request is now at the Human Right's Commission. They have not contacted me yet. They have 10 days and I am sure they will take all of them.

RESPECT

There is a little known organization in Canada called, the RCMP. Senators are claiming expenses, being charged for offences. The PMO is handing out cheques to cover re-payments and in my situation, the person who contravened Orders was promoted to the second highest rank in the CF with no charges (Oh, did I mention he made himself the judge of his own case?). I on the other hand was never promoted.

I guess us tax paying Veterans are second class citizens compared to the Senior Officers or Politicians. The laws that govern us do not apply to them in the same way. If they did, the Chief of Staff should be cutting me a cheque for $90,000.00 to cover legal costs. You think that is going to happen????

In my case, the government can't cover this one up. I have enough documentation and tapes of interviews to ensure the exact truth, of what really happened, will come out. I am prepared to put it all on the line one more time but, this time instead of in a war zone, it will be for us second class citizens. The little guy. The Veterans. The 99%!

"THE BOOK"

I wrote to Parliament and the Human Right's Commission, reference this issue. I left the names out because they are trying to help. My email was written, as follows:

 I am writing you with the greatest respect. I had contacted my MP years ago and the two weeks he said it would take him to get back to me, have long passed. This is why I am writing you. I believe you will understand why.

In 1999, I had to go through the ADR (Alternate Dispute Resolution) process because a Base Commander was Harassing me. I filed a complaint and he made himself judge. Found himself, surprisingly, NOT GUILTY. After years of following the military grievance system, my file got finally to the CDS(Chief of Defense Staff). He was the only Senior Officer I had come across, since filing my complaint, that actually agreed with me and the fact that, you can not adjudicate yourself. This was all in contravention of the written Orders too.

The" Terms of Settlement" were signed  01 April 1999. No File number on the agreement but the ADR was directed by the CDS and the legal "Terms", were signed for the government of Canada on Behalf of the Queen. Within the "Terms", it refers to the government as: Her Majesty the Queen, Her Officers, servants and agents. No one Canadian mentioned. 

During my military service I was injured severely. Both physically and mentally. I filed for Veteran's benefits sighting this case as part of my claim. VAC denied my claim because DND said that no Harassment Complaint was ever filed and there was no paperwork to substantiate my claim. I had kept my copy thinking something like this might happen. I sent DND a copy of the letter written to me by the CDS and a copy of the, "Terms of Settlement." I applied again for benefits and again, was denied. This time because DND said they (the file and documents) were destroyed as a matter of course and they could not verify my story. I went to BPA (Bureau of Pension Advocates) for help. After 1 year they had done nothing for me. I wrote my own request for a Departmental Review. I finally won my case.

DND still denies having the documents, even though there were letters from the CDS, legal documents signed on behalf of the Queen amongst many hundreds more. I asked VAC to help me force the documents from DND. They stated; it is not in our mandate. They said the only way I could tell DND how unacceptable it was that they lost or destroyed the documents (legal ones too) was to take them to Federal Court. I asked VAC to help me as a diagnosed mentally disabled veteran and their response was; it is not in our mandate. This 3 years of fighting and  suffering hospitalized me due to mental problems and torments me to this day. I lost 3 years of benefits because of this situation. There was no file number on the agreement or CDS letter nor any expiry date because I signed knowing I could use this case for pension reasons as stated in the, "Terms."

I'm diagnosed as permanently mentally disabled. I can no longer pilot, VIP Airbus Aircraft because of this. I took the only step left for myself and filed a case in Federal Court against the Queen for damages. All Officers in Canada swore allegiance to the Queen, not Canada. My "Terms", were signed by a General on behalf of the Queen. This ADR was directed by the second highest ranking Officer in Canada, the CDS. I asked the GG (Governor General our military Commander in Chief) for help and he would not even respond. This is a purely military case, dealing in military law. I have no problems with the PM or the MND. I asked them clear questions and got honest and clear answers. I didn't get the same from the military.

I am now filed in Federal Court (T-625-13). As the Plaintiff and being mentally disabled, I asked the court to appoint me a lawyer since it would bankrupt me to pay the cost and I have already given so much to this country.

Omar Khadr, gets a free lawyer. Terrorists, get free lawyers. Murders get free lawyers. BUT! A law abiding Canadian (multiple war) veteran, is denied. The same pilot that flew the "UNKNOWN SOLDIER", home from France. The Federal Courts response to my request was, to just say NO! plus photo copy and mail me an entire copy of the Federal Court Rules. That's it! ("GOT THE BOOK!")

I thought this was quite a slap in the face. It would be the same as yourself, rolling up to the steps of Federal Court and having asked for a ramp for access, they gave you some bags of concrete, a mixer, shovel and water and said, see you inside. Oh by the way, the trial it is beginning in a few hours. If you can't make it in we will file against you. Unfair to say the least! Discrimination, you bet!

I filed a Human Right's Complaint for DISCRIMINATION on my mental disability. Sir, I hope you now understand my situation as a disabled person yourself. With your assistance, might I request a Ministerial Inquiry into this matter and help with my case at the HRC (Human Right's Commission). Thank you

FYNES - QUESTION?

"During the course of the MPCC ( Military Police Complaints Commission ) inquiry, it became clear that, at all material times, the CF leadership relied heavily on the wide-scale use of sizeable CF public affairs resourses to protect the brand. In so doing, in our opinion, the CF leadership likely placed their own interest ahead of the public interest contrary to the notions of CF leadership and accountability; perhaps, eroding the credibility of the nation's armed forces in times of crisis.

It begs the questions: Do the Armed Forces need upward of 150 CF public affairs officers? Aren't CF Commanders, not public affairs staff, to be entrusted with keeping the Canadian public properly informed?

"If there is no admission a system is broken, then there is little hope that it will be fixed."

Mentally Disabled Veteran vs Federal Court

The Federal Court and myself will find out how tough Veterans really are. What an 

embarrassment and shame, as a mentally disabled veteran, having to take his own 

government to Court. We will find out!!

How many of your tax dollars do you think it will take to beat me down one more time?

"SOMEBODY!"

The government says we are a law abiding society. Governed by laws. What happens when the law makers have no idea what they are talking about and try and impose more harm on those pointing out bad and dangerous working situations. People do follow the laws but, if the law makers have lost touch with the people they are making laws for, the people will decide for them. Laws or no Laws, if politicians don't listen, then as BELL say's, "Let's Talk."

Time for a "Paradigm Shift."

If we keep pissing off the veterans, RCMP, police, guards, to name a few, who will the law makers get to do their jobs? If good honest people, the most law abiding citizens in this country are saying no to dangerous working conditions, there is definitely a problem (Alberta Prison Guards). Not with them but the law makers.

"SOMEBODY BETTER DO SOMETHING"

I really like some terms commonly used. One being...SOON. A relative term considering it means nothing really. Soon could be in 10 seconds or a week. It is all relative.

This brings me to another term used quite often and that is WOUNDED. Now a wounded police officer, fire-fighter or service member, can mean many things. Most of us think of wounded as having your body disfigured in some fashion. Unfortunately,  mentally wounded can hurt just as much as missing an arm or leg. You loose a piece of yourself. If your lucky, you might get some of it back or at least under control. For others, it is permanent.

This leads me to my last word used all too often is the word.... SOMEBODY. It is usually grouped into a sentence describing something quite unpleasant  For example; Somebody should arrest that person or somebody should help put that fire out. Lastly, somebody should go over there and teach them a lesson they will not forget.

Well people, somebody is a real life person. Somebody actually trains to go into nasty situations that you as the general public would never dream of going. We can't ever forget that these somebodies are real life people. They have hopes and dreams as you do. To think they can go into the most awful situations you can imagine and not be affected, you are kidding yourself. Those somebodies get up every day and know in the back of their minds, this may be my last day on earth. Just think about having to do that day in and day out. Not a pretty picture.

I was sent this by a caring dear friend to remind me that he does think of those somebodies like me and the gentleman pictured below. He is a somebody........I think the story with the pictures says the rest. Something or ..........somebody to think about today and everyday.

It is just slightly different in Canada but close to our neighbours.... Our Deputies, MPs & Senators to my knowledge receive the best compensation for the time served... I challenge you to read this and NOT have the will to pass it on. No one has been able to explain to me why young men and women serve in the U.S. or Canadian Military for 20 years, risking their lives protecting freedom, and only get 50% of their pay on retirement. While Politicians hold their political positions in the safe confines of the capital, protected by these same men and women, and receive full-pay retirement after serving one term. It just does not make any sense.

The Senators and/or Representatives in Government shall make no law that applies to the Senators and/or Representatives that does not apply equally to the citizens of that country. I passed it on, will you? "If you choose not to decide, you still have made a choice," and these brave soldiers have given you that right!! Absolutely!

I am a diagnosed mentally disabled Canadian Military War Veteran. I had a legal issue between myself and Senior Officers and have a legally signed "Terms of Settlement," document from the Canadian Government on behalf of your Queen. My government lost this document. By losing this document, I was denied Veteran's benefits for many years.

I do not believe the Canadian Military has lived up to the agreement and after 14 years, the Queen has been served through the British High Commission in Canada as Commander in Chief of the Canadian Military. I would have kept this matter restricted to just individuals from Canada but, the Queen's Representative (the Governor General of Canada) will not respond. I have now been forced to take strong action to resolve this issue, since I have exhausted all reasonable means at the lowest possible levels.

I apologize to the the Queen of England, for the actions of those from my country who are responsible for this situation getting to this level.

1. I requested through Kingston and Ottawa to re-negotiate through the Military Alternative Dispute Resolution, with no success.

2. I tried to get help from the Privacy and Ethics Commission.

3. Our Governor General (Queens Representative) will not even respond to any form of communication.

I filed in Canadian Federal Court a strictly military based claim.
The documents were legally registered with Federal Court and served to the parties involved.

Who Is Responsible -The Queen?

You asked what I am going to Federal Court for? I'm going to clarify if the laws of our military and country, apply to us equally or, is there a two tiered justice system.

My first question therefore is: Are there two justice systems in the military? One system for Senior Officer's and Senior NCOs and a different one, for the rest of us serving members.

My second question is; If a Senior Officer signs documents on Behalf of the Queen, who is responsible, for what was written?

Personally, if someone signs for me, they better keep to what was agreed upon.

This is a military matter for me. I went to ADR/military because of a problem with the military justice system and a Senior Officer. I went in good faith. I kept my side of the,"Agreement" but, I do not believe the ADR/military kept their's. This has everything to do with: Dignity, Honesty, Integrity, Loyalty and Respect.

It was a tough call for VAC to believe in just one side of the story of what happened to me. They only had my documents, since the other party (ADR/military) has lost their file. In my opinion, the "Terms of Settlement," had not been respected on their side. The MND answered straight forward questions when asked. The PM as well. They were upfront and I have no reason to ask them to go to court over a clearly military issue. The only persons being called, will be military, bureaucrats or medical personnel. No politicians. This is military all the way.

So, in a nutshell, I ask you again, Is there a two tiered legal system and who is legally responsible for legal documents signed on behalf of the Queen?

Is it, the person in the military with signing authority?

Is it, the Top General in Canada, the CDS?

Is it, the person with the title of "Commander in Chief"? or

Is it, the Queen herself?

I am going to Federal Court to find out the answers to these questions. As I indicated in my other posts, any help is good help.

Mentally Disabled Veterans and the Federal Court

From the CVA post on Mr. Leduc and his situation, very well said Mike Blais. There isn't anything else I could add other than, I am off to Federal Court and there is a problem. I am looking at all the options available to the mentally disabled veterans, as they apply to the courts, and their appears to be no extra assistance

My thoughts are; if you are mentally disabled and have to go to court then, the exact same public funding should be made available so that cost and personal disability do not put the veteran at an immediate disadvantage. In the courts eyes, there should be no difference in a mental disability vice physical disability.

As it is your right to represent yourself, how can you do this fairly with a mental disability? Furthermore, the veteran no longer has the choice to represent themselves because of their disability. So now, the veteran is forced to hire a lawyer. For many veteran’s, the cost of a lawyer would be a major deciding factor. This situation would not be the same if the plaintiff were not mentally disabled. This situation alone, makes this system unfair to the mentally disabled veteran. 

It would be the same if someone unable to walk could not get access into the court due to their physical disability. We build ramps and special facilities for the physically disabled but nothing for the disadvantaged, mentally disabled

This is a sad and shameful time for our country. Forcing mentally disabled veterans to go to Federal Court and without the choice other Canadian’s enjoy, are forced into financial hardship because they must hire a lawyer because of their mental disability. Shame!

MEDIA SUPPORT

Thanks to all of you veterans who have been helping behind the scenes, I have several upcoming interviews. I of course, will be discussing my lost, "TERMS OF SETTLEMENT."

Our discussions will cover: who was involved, why so many senior officers failed to act IAW CFAO's, and the Federal Case.

Issues of Privacy, Ethics and their role will also be looked at. The final area we will be covering is the Canadian Archives and their role in the preservation of historical documents.

I am sorry I can't tell you more, but the truth will finally come out.

FEDERAL COURT

As I was taught: you lead by example. It is nice to talk change. It is also cheap to talk, unless you can back it up with actions.

Calling All Turtles!

Since I have been talking history lately, is anyone out there
A "TURTLE"?

Saving Money, Spending Money, We ain't got!

Having looked at the photo, you will see why I have lots of time for a few points I wish to cover.

1. Mr. Flarhaty has his hands so far down into my pocket's now, he is playing with me. I realize he is looking for extra cash to pay for a few Billion Dollar Boondoggles, a $30.00 orange juice, Mike Duffy's living expenses in P.E.I. Pamala Wallen needs a few more flights. As a pilot myself I must explain: a mile up is 5280 feet. With all your flights, you must have met someone by now and have been fully qualified.

2. After multiple attempts on my part to get General (ret'd) now Senator Dellaire to help us but he must be out on the front lines with our, "Walmart Greeter", our MIA, "Commander in Chief", our very own (paid for by us to represent the British) "Governor General".

3. This concept might be foreign to some at 101 Colonel-By Drive but here it is: let's try to make a decision. There are some things we need in the military and I bet we could find a company right here in Canada to do it for us.

4. We need a new fighter. The Avro Arrow comes to mind. Our old Browning pistols are only good as paperweights now. They spend more rounds jamming than firing. Canada used to lead the world in ship building. What happened there? The Army needs new equipment too. Hey! they just got back from Afghanistan. Before we piss all them off to and they leave the military as well, maybe we can get some ideas from them.

5. As Henry Fords answered when asked why do you pay your workers so much? His answer was simple, If they don't have the money, they will not buy the cars!

6. Lose the parts that are old and outdated. Our "Walmart Greeter" and the Chamber of not quite sober, second thought, The Senate". Save money keep history. Hire these actors for a dollar. They can live on the prestige while we can pay Canadians to design, build, and manufacture the planes, ships and other required military stuff.

Mr. Flarhaty maybe then you can reach into my pockets and find some money. Please don't be too friendly while getting your tax dollars. We are sensitive proud Canadians.

sick and tired of answering questions about my dog!

Yes, he mauled six people wearing P.Q. Separatist T-shirts,

nine teenagers with pants hanging past their cracks and

baseball caps on backwards, three flag burners and a Muslim jihadist.

FOR THE LAST TIME... THE DOG IS NOT FOR SALE ! ! 

I do not approve of his smoking but he says it gets the bad taste out of his mouth.

Are the Queen and GG just Historical Actors?

The Queen and GG are actors in a historical display of the way it used to be. Simple present day, if you have no power, you can’t take legal responsibility, then you stay away from the pen and don’t sign.

 If you are there for ceremonial purposes then be a figure head and act like one. Actor's should not sign anything legal because you can't take direct responsibility. Simple. Keep the two separate. Who we parade around because of history and who signs legal documents. 

I believe we should not pay the GG. It is ceremonial acting position and he should do it as his personal contribution to Canada. It should not be considered a job but a privilege to perform historical acts. 

That is all they are: the Queen and GG, historical actors. They have no power.

For Us 99% 'ers (Commoners) Common Sense To Us, Always Gets In The Way

Just a regular Canadian guy, asking common sense questions. My questions for you, as Canadian citizens, are as follows:

If the Canadian military has a dispute and it is a Canadian matter, why are the legal documents signed by military personnel on behalf of the Queen?

If the MND is the holder of military power in Canada, why does the military not sign on behalf of the MND or just Government of Canada and leave the Queen out of it?

If the GG is in power for the Queen when she is away from Canada, why does the military not sign on his behalf as her representative, our military "Commander in Chief"?

This sounds more like legal avoidance than a correct and factual way of doing things.

If the Queen has no power and therefore the GG too, legally the person who is responsible for the decision taken, should sign and take full accountability.

Lastly, my final question for now, are not all legal correspondence from the CDS and the Queen deemed historic and must be archived for this reason? 

Common Sense is Confusing Sometimes. I think the “KISS” principle applies perfectly here. Maybe the Government might benefit from the “KISS” principle so we all can understand. Do you not agree?
