I am trying to resolve a situation which appears to be worsening with time. Due to the Supreme Courts ruling on who actually is in charge of the CF, I am writing to you to cover all bases. In the letter excerpt below, If you could Replace Governor General with MND, then I will have requested the same information from you. The following Departments have been contacted and either no assistance was forthcoming or it was stated as the wrong department. They are: DND Privacy, VAC, VAC Ombudsman (enclosed below), the Justice Department and the Governor General. I trust your office will have better luck finding where these documents were stored and why they were not forwarded to VAC. General Baril was the signatory on his own letter to me and BGen Brando was the signatory on the Queens document.


The Governor General of Canada has been contacted by me. I asked him to look into this situation. He is by default the Commander and Chief of the Canadian Military and, the Queen's Representative. I sent an email to the Governor General in March. I was responded to almost immediately by his office. My email was to be passed to the Communications Department. This location is where the email did go, didn't go, or no one knows because no one seems to know about this email.


Luckily, not having just fallen off the "Apple Cart", I anticipated this behavior. I waited for a reasonable period of time (2 months) and as suspected, received nothing.


I called the Office of the Governor General and asked about the email I sent. The same one that they responded to. They indicated no such email or response was ever received or responded to. Funny because this was the reason why I wrote to the GG in the first place. I wrote to him, asking him to look into DND losing a letter sent to me from the CDS and one from the Queen, which had somehow gone missing.


Getting back to me not falling off the "Apple Cart", I had sent a Registered Letter to the Governor General, just in case this unusual situation might occur. Unusual you say? More like the norm.


They still said that they had no record of any correspondence from me. Bummer about the Registered Letter, signed for by B. Benammar.


The office will as before, get back to me. Please excuse me if I don't hold my breath on this one because, I am a Veteran with serious concerns and he is the Commander and Chief of the Canadian Military. Between himself and the Privacy Commission, who was asked about the same missing letters, somebody should know something about something.


It is funny. As a Veteran, the Commander and Chief didn't mind putting my life on the line following orders and going into war zones on behalf of Canada. I was not afraid. Is he afraid to answer some straight up questions from a Veteran? So far, it appears to be the case.

For the Public - An Actual Case Example

So you say, VAC and DND are separate?

I feel like I work for Ripplies," Believe it or Not!" Sadly though, what I will write here in clear terms so you can understand, the problems facing a Veteran in an actual ongoing case:

I will give you a time line and feeling of the atmosphere on a Military Base at the beginning of this Veterans situation and subsequent case.

It was the late 1990's, at Canadian Forces Base Trenton, Ontario. One aircrew member recently took an axe to his wife, as I recall and then hung himself. Fernette I think was his name. A pilot, Steve Kovacks committed suicide a few months later. His wife was several months pregnant at the time. As I remember it, the pilot, Steve was involved in a situation while away from the Base. He was cleared to go back flying but, there was to be another investigation. The reason or nature of this investigation, unknown to me officially.

In the midst of all of this death on the Base in Trenton, this individual thought it would be a nice idea to start a fund raising event. This person worked very hard using their own time and money to promote the idea. It was to help struggling military families and the orphans in Bosnia.

The Base Commander at Trenton, decided that he was against this charitable idea and let the military member who was trying to do this kind thing, know it. The military member, believing strongly in the goodness of the idea continued on anyway. Shortly thereafter, this person perceived that their job and future possibilities for advancement, were being undermined by the Base Commander. This was the same Base Commander who didn't think a charity was a good idea.

Having these concerns, this military member went to their supervisor and tried to have the situation resolved at the lowest level. No luck with this course of action, so this person submitted a Formal Harassment Complaint against the Base Commander at Canadian Forces Base in Trenton, Ontario. (the same one Russ Williams was from and was also the Base Commander of).

IAW (in accordance with) CFAO (Canadian Forces Administrative Orders) 19-39, the military person hand delivered the Formal Harassment Complaint to the CO (Commanding Officer of 437 Squadron Trenton) for delivery to the next highest rank above that of the Base Commander (who is a Colonel), the BGen (Brigadier General) at the Base in Trenton at this time. The BGen, minuted the Formal Complaint back to the  Base Commander so that he could deal with it at his level. He indicated that if this was not possible, to hand the Formal Complaint back to him for investigation, IAW CFAO 19-39.

The Base Commander decided himself, that he would not have someone of a higher rank investigate him so, he decided to make himself the judge of this Formal Complaint against himself. The Base Commander hired his own Base Administrative Officer (the professional in the proper handling of Harassment Complaints) to do the investigation.

Now we have all seen the news about Russ Williams. Base Commanders are in charge of the: Hospital, Police, Administrators, Squadrons and so on. This person who put in a Formal Harassment Complaint against the Base Commander of Canadian Forces Base Trenton. IAW Orders as written, now has the accused as the Judge, in contravention of the orders. The investigator is a Major, trained in the proper handling of Harassment Complaints, agreeing to do the investigation, in contravention of the orders. The members Commanding Officer, knowing the situation, did nothing to help, in contravention of the orders. Not one single Officer on the Base in Trenton would help this person as required by the orders as written in CFAO 19-39.

The Base Commander found himself, NOT GUILTY!!!

The military member was subsequently transferred to Canadian Forces Base Kingston. The Formal Complaint, and it's handling was brought forward to Land Forces Command. No assistance was forthcoming.

So just in summary, no Officer of any rank, at any time assisted this military person. Why? Everyone was fearful. If these Senior Officers can do this then, what would they do to you if you stepped in to help? Everyone this person could have gone to worked for the Base Commander who was not IAW Orders. Not the Doctors. Not the Social Workers. Definitely not the Base Administrative Officer (doing the investigation)

Remember I asked are VAC and DND separate? Let me put them together for you so you understand exactly how it is done.


VAC asks DND for paperwork regarding this person because a claim has been filed alleging:: Generalized Anxiety, PTSD and Alcohol Abuse Disorder caused by the situation detailed above. DND comes back and says that there is no substantiation in writing. Nothing from the Military Doctors. Nothing from the Military Social Workers. Nothing from the Base Administration Officer so therefore, CASE DENIED!!!

Of course there is nothing to be found, no one would help. Where exactly......VETERANS AFFAIRS....... was this person supposed to go when the corruption is so prevalent and unchecked that now the only one left to pay is the Veteran. Shame. Shame on you all. This is far from over. The truth will come out. All the documents and tapes are hidden away and can't be lost or destroyed now.


DIGNITY   HONESTY   INTEGRITY   LOYALTY   RESPECT will not be the victims here!

The DND VAC Paperwork Shuffle

Sadly I must say that there is another one for the record books. This one is so incredible, it defies explanation and accents the almost comical problems at DND and VAC.

The last sentence from my first paragraph sums it all up. DND and VAC are separate....kind of. DND supplies VAC with the requested documents so that Veterans can prove their claims. If documents just happen to go missing from DND, you as a Veteran, lose. This is in most part what happens. In the odd situation, the Veteran has kept a copy of the documents that don't exist and VAC is then allowed to make a new decision, over turning their last.

Wait!!!! It get's better. If the Veteran finds out information after VAC has decided to reject their claim, and subsequently proves the claim is factual, the Veteran is again punished. Why you ask? Because, the new decision is not amending the old one it is a new one which gives you what is known as a,"Decision Date." This has nothing to do with when you filed your original application and they got it wrong. No! it is from when you, as a Veteran, found new information and they could now not disprove your claim. Nothing is back dated. Your Decision Date starts when they decide, after your appeal or multiple appeals are successful.

Looking For Assistance

I have asked from CTV news to cover my story. He has followed my information from the start and it is only fair that he should have the first opportunity. If he declines, then I am wide open to offers.

The second area where help is needed is in the legal department. Because of what has happened in my grievance process and the large numbers of Senior Officers who decided not to assist me as required by CFAO's, I am looking for a civilian lawyer to take this on. BPA and the Legion are both paid for by the government and that is who I am fighting. I would ask them under my particular circumstances, to pay for a civilian lawyer but, they won't because they can't control them through their pay cheque and thus the NVC comes through again for the Veteran.

Sir; My name is Michael Cole. We spoke at the Hill about my case of document cover-up. Full details are on my Blog with actual documents. My claim for benefits was delayed for an extended period of time because BPA said it was too hot to handle. I had to appeal the VAC decision myself.

Through my research I discovered important documents proving a portion of my claim were deemed non-existent. I kept my copies. The documents that just happened to go missing were a letter from the CDS directly to me with CC copies to the Base Commander in Trenton among others and an Agreement between myself and the Government of Canada on Behalf of the Queen.

Historical documents like these do not go missing. The response from DND, DND privacy and the Privacy Commission state: THESE DOCUMENTS DO NOT EXIST. VAC Ombudsman's Office has sent me a letter saying they are unconcerned and it is nothing to do with VAC. They told me to contact the Government of Canada general switchboard to find out who would help me. SAD.

Formal Complaint sent to GG in March 2012. Receipt confirmed. Registered letter sent to GG received early May 2012. I requested the GG get involved since he is Commander and Chief of the CF and the Queens Rep. He alone is the next chain of command to get this situation looked into.

My Ever Helpful Conservative MP Rick Norlock of Hastings (Trenton)

I realize that neither you nor your office has helped me in any way. I gave you all the information you required to help but chose to do nothing. Trenton, Ontario is a military town. I am a Veteran. We have lots of friends that are helping. We will have no trouble listing all the assistance you have given. It does entail the grand sum total of....NOTHING!!!

Equitas Society – June 2012 Update

The Equitas Society: formed in September 2011 to provide the legal disbursement costs for an intended law suit to be conducted, pro bono, by the law firm Miller Thomson LLP to challenge the 2006 New Veterans Charter and the reduced disability benefits this new Act provides compared to the previous soldiers’ Pension Act, or provincial worker compensation programs.

We Finally Have Contact With Governor General's Office

Thank heavens! I finally got a hold of a real person. A very pleasant chap by the name of, Antoine Morin. He seemed very genuine in his wishing to follow-up on my correspondence from March as well as the Registered Letter sent and received in May 2012. We started our talk at approx 15:15hrs and finished at 15:30hrs, or so..

He politely requested 24-48 hours to find out about the information requested. I gave him my sympathies since I have been at this since 2010, and said that this would be no problem for me.

Re-Cap of Where We Are: The Score Board if you like:

1. Veteran of 25 years service to our country, "0"

2. Others in Government, "perfect score thus far."
These Include;
a. DND
b. DND Access to Information
c. Access to Information Commission
d. Veterans Ombudsman's Office

Those listed in a. through c., said that the documents requested, did not exist.
Those at d., said that it is not a Veteran's Affairs issue. The fact that missing documents don't matter when they delay benefits to Veterans is not something they help with. (See Formal Complaint 12-3680-149)

I have "THESE DOCUMENTS THAT DON"T EXIST." We can only play hide and seek so long. As a reminder to all of the public servants out there, if they can loose these documents (Letter from CDS Chief of Defense Staff and Queen) then how do you think you will be treated, if you have a dispute with the Government.

The truth will come out! I just wonder who will be in the hot seat when it does? I sure wouldn't want to be that person.

We All Need To Learn

I trust most of us have read the book,"Animal Farm." To make my point, the rules initially were to benefit all on the farm. As time went on, the rules slowly started to change. Most were too busy to notice until it was too late.

Within the magazine, "Esprit de Corps," there was an interesting article reference the Military Family Fund. The highly knowledgeable individuals who wrote the piece, asked some very pointed questions. Very sound questions to be sure but, I have a few lingering ones myself.

If public money is given to support military families, why isn't the public in control of this fund? Why when you retire from the military are you no longer able to receive any assistance from this fund?

There are serving and retired military families suffering equally. Only serving military qualify, with conditions. Ah! the rub. It is all tightly controlled by the chain of command. As always, if you ask for help, you can't do it privately. You must tell your boss and he tells others and so on.

Pride is something military personnel have a lot of. Would it not be more clear and transparent if the civilians who gave money out of kindness and generosity, would control who benefits and who knows. Again with the military controlling the military fund, is this not yet another conflict of interest? I am sure many civilians would be happy to assist for no fee at all. Experienced  military family members perhaps, might have a vested interest!!

Promoted Officers

In reviewing my files, I started looking at all the names of the officers who worked for, or commanded, the officer who elected to proceed against the orders, as written in CFAO 19-39. I found something quite odd. All of these officers, that I have traced thus far, were promoted. (disciplined.....?????)

I guess that was the one trait, as the complainant, I didn't achieve. This missing trait was, non-compliance with written orders.

I knew there was a reason I was the only one who didn't get promoted!

My Request of the Veterans Ombudsman


How can Veterans prove their cases, if important documents are untraceable and go missing?

I am not a historian but, I believe strongly , that these documents must be at the National Archives or DND.

I kept my copy.

If I did not, my case, would not have been successful.

Question???

If the Canadian Government can misplace documents of such significance, what happens to other veterans documents?

The Governor General of Canada has been contacted by me. I asked him to look into this situation. He is by default the Commander and Chief of the Canadian Military and, the Queen's Representative.

I AM REQUESTING!

I am requesting your office (VAC Ombudsman) help me get to the bottom of this situation by supporting my request of the Governor General. (He was first contacted March 2012 - receipt acknowledged and again, 2 months later by Registered Mail. No reply, just Canada Post Confirmation)

I will be available, 1400 hrs, 06 June 2012, at the War Memorial, to answer any of your questions. I hope my work helps others looking for documents held by the Government.

Request for Ombudsman to Follow-up on GG Letter


Email sent to GG acknowledged receipt, requesting the GG investigate loss of documents listed above. GG covers Queens Documents and in Commander and Chief of Military. Most appropriate person to investigate (head of both).

No Response from GG Office after original acknowledgement.(March)

Called GG Office 2 month's later and no record of acknowledged email. There was no record of me contacting the Office of the GG even though I sent a REGISTERED LETTER to his Office and it was signed for by B. Benammar, 03 may 2012. Three months have now passed and I would like your Office to find out what exactly is being done. Losing these documents resulted in significant delays in receiving Veterans Benefits.

A complaint was filed with the Privacy Commission and an investigation was carried out by them. I was dis-satisfied with their initial investigation since letters from the Queen and CDS just do not go missing.

I responded to the Privacy Commission by REGISTERED LETTER signed for by B Wright 25 April 2012.

Requesting action. Following up with Eposting so this does not go missing too.

I Expected More From The Governor General of Canada

In these days of modern technology, it is surprising who seems not to know important information. I learned at an early age, the 7 rules of being in the Government. These are:

Show concern!
Act surprised!
Admit nothing!
Deny everything!
Don't come first!
Don't come last!, and for god's sake
Don't volunteer!

Medical Administration for Veterans - Blue Cross vs. Sun Life

I received a respose back from Sun Life, the people who run the Public Service Health Care Plan. They indicated that they would be thrilled to take over the administration of our Veterans medical from Blue Cross but there is one thing we must do. See actions required below.

"The best way to make your voices heard is for each member who prefers their plan to be administered by Sun Life Financial to speak with the Pension Office individually is able to determine the depth of this request.You may contact the 

Canadian Forces Pension Centre at 1-800-267-6542 for further assistance".

Group insurance program

66.(1) The Minister may

(a) establish or enter into a contract to acquire a group insurance program ( I believe it to be Blue Cross for Veterans) comparable to the Public Service Health Care Plan established by the Treasury Board

(2) A member, a veteran or a member's or a veteran's survivor may elect to participate in a group insurance program referred to in subsection (1) if they meet the prescribed eligibility requirements.

I have been waiting 6 months for my latest decision from VAC / Blue Cross. When I deal with Sun Life ( Public Service Health Care Plan established by Treasury Board) I never wait more than two weeks for a decision.

I SEE A DIFFERENCE, DO YOU???

group,approach other companies and negotiate a better and

more fair deal. Your choice of course but, it sure would give

us some real power to bargain with and ensure we get a

I am requesting a monetary breakdown of the costs paid for my current Blue Cross coverage. I realize more may be forthcoming but, I wish to put out applications with other health providers to see what services they can offer me.

Blue Cross in it's present form is for a Veteran, unworkable and someone like Sun Life might be happy to pick up the contract. I will be speaking to them soon regarding this asspect of my compensation.

I look forward to receiving the numbers and the methods used to determine the costs so I can have them verified. Thank you for your time.
